Those scooters are not designed to take passengers. Just by riding it with another kid he’s already being irresponsible and possible breaking the law. Cars have nothing to do with it.
I think I am just saying that the argument “two children on a scooter” seems to be a scapegoat.
As a kids, we we would ride on our local neighbourhood streets like so. I am not sure what the argument would be if we got hit by a car.

So I’ve checked and the “two kids on one scooter” is actually not a problem in UK. Private e-scooters are illegal on public roads and you need a driving license to rent one. That’s why he’s being charged with causing death by driving unlicensed.
But you were asking about the car owner for some reason. I still fail to see how is that relevant.
